ORDER On December 3, 1980, Joint Intervenors filed a motion with the Commis-sion requesting it to direct the Atomic Safety and Licensing Board to certify to it several questions regarding application of the Commission's June 20, 1980 Statement of Policy, entitled "Further Commission Guidance for Power Reac-tor Operating Licenses,"
to the Diablo Canyon Nuclear Power Plant licensing proceedings.
The Commission denies the request because the Licensing Board now has the authority to rule on the issues raised by Joint Intervenors.
See "State-ment of Policy: Further Commission Guidance for Power Reactor Operating Licenses,"
CLI-80-42, 12 HRC (December 18, 1980). Consequently, this motion does not raise such exceptional circumstances as to warrant the extraordinary involvement of the Commission at this stage of the proceeding.

ORDER While the Board was reviewing the proposed findings in the wake of Three Mile Island-2 accident (TMI-'2), on May 9, 1979, the Joint Intervenors filed a motion for the Board to
\\
reopen the evidentiary hearings in the light of TMI-2 or in the alternative to certify the questions to the Commission.
The motion was supplemented by fi1ings on May 10, 16, and 17, 1979.
On May 24,
- 1979, the staff requested the Board to defer ruling on the motion pending completion of the Staff inquiry and report as to the effects of the TMI accident on the Diablo Canyon proceeding.
On June 1,
1979, Pacific Gas and Electric (PGBE) opposed the motion.
On June 5,
- 1979, the Board issued an order which stated that it will defer its ruling until it receives the Staff's report.
The Board recognized that the Staff analysis would in fact be a Commission position on those issues which are TMI related.
Since that time there have been numerous NRC issuances relating to TMI-2 matters.
To date, the Staff has not informed this Board as to the status of the May 24, 1979, request to defer ruling on the motion. It is, this 17th day of December 1980 ORDERED That the Staff inform the Board if its request to defer continues to be the Staff. position.
