2.206 Petition regarding Pilgrim current licensing basis for flooding (OEDO-15-00479)(CAC NO. MF6460)- 60 DAY STATUS Date: Wednesday, October 05, 2016 4:18:00 PM Mr. Lochbaum, In accordance with MD 8.11, I am writing to provide you a status update on your 2.206 petition dated June 24, 2015, regarding the current licensing basis on flooding for the Pilgrim Nuclear Power Station (Pilgrim). This provides the status since my last update to you on August 8, 2016.

On August 16, 2016, Travis Tate, Branch Chief sent you an e-mail (ADAMS Accession No. ML16229A525) clarifying your questions in your e-mail dated August 9, 2016, regarding the status of the NRC staffs review of the petition, the NRCs issuance of Interim Staff Response To Reevaluated Flood hazards Submitted In Response To 10 CFR 50.54(f) Information Request- Flood-Causing Mechanism Reevaluation for Pilgrim dated August 4, 2016, and the staff process for the evaluation of your 2.206 petition.

On August 18, 2016, Entergy (or the licensee) sent a letter (ADAMS Accession No. ML16250A018) to the NRC, Request for Deferral of Actions Related to Beyond-Design-Basis External Events Flooding Actions- Commitment Changes. Entergy is proposing commitment changes related to the 50.54(f) request for information, issued by the NRC in March 12, 2012 and is also requesting deferral of actions related to Beyond-Design-Basis External Events for flooding at Pilgrim in the light of its intention to permanently shutdown Pilgrim on May 31, 2019. The NRC staff is reviewing the proposed commitment changes and deferral requests and will respond to the licensee before the earliest commitment date of December 31, 2016.

The staff has not reached a resolution on the on-going reviews for Pilgrim that are related to your petition. Once resolution is achieved, the staff will reconvene the petition review board to discuss the petition and prepare a proposed Directors Decision in accordance with the 10 CFR 2.206 process.
