Friday, January 15, 2016 12:00 AM Mr. Lochbaum, In accordance with MD 8.11, Review Process for 10 CFR 2.206 petitions, I am writing to let you know the initial recommendations of the Petition Review Board (PRB) on your petition dated June 24, 2015 regarding the current licensing basis on the flooding for the Pilgrim Nuclear Power Station (PNPS).

Your petition request that NRC take enforcement action to require that the current licensing basis for PNPS include flooding caused by local intense precipitation/ probable maximum precipitation events meets the acceptance criteria of MD 8.11. The issues raised in the petition are subject of NRC staff review and evaluation and therefore the PRBs initial recommendation is to accept and hold the petition until a resolution is achieved. We expect the resolution of the issue by December 2016.

The PRB also recommends to reject two supplementary issues raised by the petitioners in the teleconference on Aug 5, 2015: (1) the issue of submerged safety-related cables which was resolved in a Directors Decision (Agencywide Documents Access and Management System Accession No. ML13255A191) and (2) the petitioners request for the updated site plan which is in the scope of the Freedom of Information Act process and not in the 2.206 process.
