NOTICE OF VIOLATION AND SUMMARY OF ENFORCEMENT CONFERENCE
(NRC INSPECTION REPORT NOS. 50-413/87-43, 50-414/87-43,
50-369/87-45, 50-370/87-45, 50-269/87-50, 50-270/87-50, AND
50-287/87-50)
This refers to the Nuclear Regulatory Commission (NRC)
inspection conducted by
Mr. William Tobin on December 8-9, 1987.
The inspection included a review of
activities authorized for your Catawba, McGuire, and Oconee facilities. At the
conclusion of the inspection, the findings were discussed with those members
- of
your staff identified in the inspection report sent to you on January 11,
1988.
NRC concerns relative to the inspection findings were also discussed in
an Enforcement Conference held on January 15,
1988.
A summary of this
Enforcement Conference is enclosed. The Enforcement Conference was beneficial
in that it allowed you to better explain the numerous examples of failing to
protect Safeguards Information when in electronic transmission and while in
storage which you reported to us on December 3, 1987.
Areas examined during the inspection are identified in the report.
Within
these areas, the inspection consisted of selective examinations of procedures
and representative records,
interviews with personnel,
and observation of
activities in progress.
The inspection findings indicate that certain activities appeared to violate
NRC requirements. The violations, references to pertinent requirements,
and
elements to be included in your response are described in the enclosed Notice
of Violation.
The violations described in the enclosed Notice of Violation are of significant
concern to us for several reasons; the extended period of time during which the
violations occurred and repeated opportunities for your staff to have
identified them, the voluminous amount of Safeguards Information involved, and
the similarity of these violations to a previous violation involving failures
to properly destroy Safeguards Information which was furnished to you in our
letter of June 15,
1987.
While these violations demonstrate a lack of
management oversight at your Corporate Nuclear Security level, they also
question the adequacies of your quality assurance audits and employee training
relative to the requirements of 10 CFR Part 73.21.
