This letter refers to the Enforcement Conference held at our request at the
Region II Office on June 1, 1987, to discuss the findings of the inspection
conducted by Mr. A. Tillman at your Corporate office on May 11-12, 1987. These
are detailed in Inspection Report Nos. 50-269/87-20, 50-270/87-20, 50-287/87-20,
50-369/87-17, 50-370/87-17, 50-413/87-19 and 50-414/87-19.
The findings
concerned your discovery of inadequate destruction of Safeguards Information by
your Nuclear Licensing Office during a period in excess of two years.
It is
our opinion that this meeting was beneficial and has provided for a better
understanding of the inspection findings and enforcement issues.
The violation described in the enclosed Notice of Violation is of particular
concern because of its extended duration without detection. Of further concern
is the acknowledged lack of training in the protection and destruction of
Safeguards Information and the failure to identify the inadequate destruction
practice during quality assurance audits conducted in 1986 and 1987.
This
violation demonstrates a lack of management oversight and an apparent weakness
in employee training relative to the protection of Safeguards Information. The
violation, references to pertinent requirements, and elements to be included in
your response are described in the enclosed Notice of Violation.
In accordance with 10 CFR 2.790(d) and 10 CFR 73.21, safeguards activities and
security measures are exempt from public disclosure; therefore, the enclosures
to this letter, with the exception of the report cover page which presents a
nonexempt summary, will not be placed in the NRC Public Document Room.
The responses directed by this letter and its enclosures are not subject to
the clearance procedures of the Office of Management and Budget as required by
the Paperwork Reduction Act of 1980, PL 96-511.
