NOTICE OF VIOLATION

(NRC INSPECTION REPORT NOS. 50-269/95-04, 50-270/95-04, AND

50-287/95-04)

Gentlemen:

This refers to the inspection conducted by William Tobin of this office on

April 3-5, 1995 in response to a February 20, 1995 event at your Oconee

Nuclear Station involving the discovery of unsecured drawings marked as being

Safeguards Information. At the conclusion of the inspection, the findings

were discussed with those members of your staff identified in the enclosed

report. Additionally, on April 19, 1995, Mr. Mark Patrick of your Catawba

Nuclear Station staff was advised of the results of our review of the

inspection findings. Mr. Mark Patrick has been identified as the point of

contact with the NRC regarding Safeguards Information Events.

As identified in this report, the inspection consisted of selective

examinations of Safeguard Events, procedures and records, interviews of

knowledgeable personnel, observation of activities in progress, and

examination of drawings.

Based on the results of this inspection, certain of your activities appeared

to be in violation of NRC requirements, as specified in the enclosed Notice of

Violation (Notice). This violation is of concern because it could have

allowed for the disclosure of Safeguards Information through your unsecured

automatic data processing system.

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response. In your

response, you should document the specific actions taken and any additional

actions you plan to prevent recurrence. Your response may reference or

include previous docketed correspondence, if the correspondence adequately

addresses the required response. After reviewing your response to this

Notice, including your proposed corrective actions and the results of future

inspections, the NRC will determine whether further NRC enforcement action is

necessary to ensure compliance with NRC regulatory requirements.

In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice," a copy of

letter, its enclosure(s), and your response will be placed in the NRC

Public Document Room (POR). To the extent possible, your response should not

include any personal privacy, proprietary, or safeguards information so that

it can be placed in the PDR without redaction. However, if you find it

necessary to include such information, you should clearly indicate the

specific information that you desire not to be placed in the PDR, and provide

the legal basis to support your request for withholding the information from

by the Paperwork Reduction Act of 1980, Pub. L. No. 96.511.
