ENCLOSURE 1 NOTICE OF VIOLATION JA I

1 993 Duke Power Company Docket Nos 50-269, 270, and 287 Oconee Nuclear Station License Nos. DPR-38, 47, and 55 During an NRC Inspection conducted on December 14-18, 1992, a violation of NRC requirements was identified. In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the violation is listed below:

10 CFR 50, Appendix B, Criterion V requires activities affecting quality to be accomplished in accordance with procedures. Procedure NDE-35, "Liquid Penetrant Testing" Revision 13, Figure 3,,specifies that the area of interest for liquid penetrant examination for reactor coolant pressure boundary butt welds is the weld and the one half inch of adjacent base material on each side of the weld.

On December 15, 1992, procedure requirements were not followed for liquid penetrant examination. One half inch of adjacent base material upstream of reactor coolant pressure boundary weld 1PRZ-WP63-7, a pressurizer nozzle to safe end butt weld, was not examined during the liquid penetrant examination of that weld.

This is a Severity Level IV Violation (Supplement 1)

Pursuant to the provisions of 10 CFR 2.201, Duke Power Company is hereby required to submit a written statement or explanation to the U. S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555, with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector, Oconee, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a "Reply to the Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. If an adequate reply is not received within the time specified in this Notice, an order or Demand for Information may be issued as to why the license should not be modified, suspended, or revoked or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extend the response time.

2 NDE examiners contacted during this inspection were very knowledgeable in their areas of responsibility.

The licensee has a weakness related to ISI weld drawings which has caused unnecessary PT examination coverage, and resulted in unnecessarily long stay times in a high radiation area.

One violation: "Failure to Follow Liquid Penetrant Procedure"- paragraph 2c, and two unresolved items:

"Failure To Identify Pipe Support Design Deficiencies"- paragraph 2d, and "Failure To Conduct Annual Vision Acuity Examination"- paragraph 2d, were identified.
