H. B. ROBINSON STEAM ELECTRIC PLANT, UNIT NO. 2 - CORRECTION OF IMPLEMENTATION DATE FOR LICENSE AMENDMENT NO. 245 REGARDING ADOPTION OF EMERGENCY ACTION LEVEL SCHEME PURSUANT TO NEI 99-01, REVISION 6, "DEVELOPMENT OF EMERGENCY ACTION LEVELS FOR NON-PASSIVE REACTORS" (CAC NO. MF6222)

Dear Mr. Glover:

On April 28, 2016, the U.S. Nuclear Regulatory Commission (NRC) issued Amendment No. 245 to Renewed Facility Operating License No. DPR-23 for the H. B. Robinson Steam Electric Plant Unit No. 2 (Agencywide Documents Access and Management System Accession No. ML16061A472). This amendment was in response to your application dated May 13, 2015, as supplemented by letter dated November 19, 2015. The amendment revised the emergency action level scheme to a scheme based on Nuclear Energy Institute (NEI) document NEI 99-01, Revision 6, "Development of Emergency Action Levels for Non-Passive Reactors," dated November 2012. NEI 99-01, Revision 6, was endorsed by the NRC by letter dated March 28, 2013.

After issuance of the amendments, we found that the amendment implementation date did not reflect the requested date in the licensee's November 19, 2015, submittal. The originally requested implementation period of 180 days will not support the licensee's needs since the NRC completed its review and issuance of the amendment earlier than anticipated. Thus, we have corrected the implementation date of the amendment. We ask that you please refer to the revised enclosure provided with this letter.

The Nuclear Regulatory Commission (the Commission) has found that:

A.

The application for amendment by Duke Energy Progress, Inc. (the licensee),

dated May 13, 2015, as supplemented by letter dated November 19, 2015, complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commission's rules and regulations set forth in 10 CFR Chapter I; B.

The facility will operate in conformity with the application, the provisions of the Act, and the rules and regulations of the Commission; C.

There is reasonable assurance (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commission's regulations; D.

The issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public; and E.

The issuance of this amendment is in accordance with 10 CFR Part 51 of the Commission's regulations and all applicable requirements have been satisfied.

Enclosure

Accordingly, by Amendment No. 245, Renewed Facility Operating License No. DPR-23 is hereby amended to authorize revision to the emergency action level technical bases document as set forth in the licensee's application dated May 13, 2015, as supplemented by letter dated November 19, 2015, and evaluated in the NRC staff's safety evaluation enclosed with this amendment.

This amendment is effective as of its date of issuance, and shall be implemented by November 30, 2016.
