Dear Mr. Dave Helker:
By letter dated December 14, 2015 (Agencywide Documents Access and Management System (ADAMS)
Accession No. ML16005A167), Exelon Generation Company, LLC submitted the Oyster Creek Nuclear Generating Station (OCNGS) Physical Security Plan (PSP), which also included Training and Qualification Plan, (T&QP) and Safeguards Contingency Plan (SCP), Revision 14, to the U.S. Nuclear Regulatory Commission (NRC) under the provisions of Title 10 of the Code of Federal Regulations (10 CFR), Part 50 Domestic Licensing of Production and Utilization Facilities, Section 50.54 Conditions of License paragraph (p)(2). The enclosure to the letter dated December 14, 2015, contains Safeguards Information, which is protected under 10 CFR 73.21 and is withheld from public access pursuant to the requirements of 10 CFR 9.17 (NS113213).
The NRC staff is currently reviewing the submittal and is enclosing a request for additional information (RAI) to support its review. The NRC staff has determined that the attached RAI does not contain any safeguards and/or security-related sensitive information.

NSIR REQUEST FOR ADDITIONAL INFORMATION - TAC A11011 10 CFR 50.54(p)(2) CHANGES TO SECURITY PLAN OYSTER CREEK NUCLEAR GENERATING STATION DOCKET NO. 50-219; LICENSE NO. DPR-16 In a letter dated December 14, 2015, Exelon Generation (the licensee), submitted Revision 14 to the Oyster Creek Nuclear Generating Station (OCNGS), Security Plan, (Agencywide Documents Access and Management System (ADAMS) Accession No. ML16005A167). The NSIR/DSP/RSB staff has reviewed Attachment 1 to this letter (Revision 14 of the OCNGS Security Plan, designated as Safeguards Information) and the following Request for Additional Information is provided:
Revision 14 contains one change that adds a specific caliber of ammunition that will be provided for use with a new handgun currently being utilized at OCNGS.

Clarification: Specify/confirm the number of rounds (ammunition) that will be provided for use in the subject handgun. Confirm that this information will be added to the OCNGS security plan as soon as practicable.
Regulatory Basis:
10 CFR Part 73, Appendix B,Section VI, paragraph G.2.(a) states that; The licensee shall ensure that each individual is equipped or has ready access to all personal equipment or devices required for the effective implementation of the Commission-approved security plans, licensee protective strategy, and implementing procedures.
10 CFR Part 73, Appendix B,Section VI, paragraph G.2.(a) states in part that; The licensee shall provide armed security personnel with the following: (1) Gas Mask; (2)
Body Armor; (3) Ammunition/equipment belt, and ; (4) two-way radio.

Clarification: Clarify/confirm the U.S. Bureau of Alcohol, Tobacco, Firearms, and Explosives categorization of the affected firearm and clarify/confirm the legal authority under which the licensee may purchase, possess, and use this firearm under Federal and State laws. More specifically, address the need for a Federal Firearms License and/or the need for exemption from State firearms laws that would otherwise restrict or prohibit the possession and use of the subject firearm. Confirm that this information will be added to the OCNGS security plan as soon as practicable.
Regulatory Basis:
10 CFR Part 73, Appendix C,Section II, paragraph B.3.e. Policy Constraints and Assumptions states that; The safeguards contingency plan shall contain a discussion of State laws, local ordinances, and company policies and practices that govern licensee response to incidents and must include, but is not limited to, the following. (i) Use of deadly force. (ii) Recall of off-duty employees. (iii) Site jurisdictional boundaries. (iv) Use of enhanced weapons, if applicable.
