NOTIFICATION OF ISSUANCE OF EXEMPTION Consistent with the Commissions policy on notification of NRC adjudicatory bodies and all parties of information on issues in cases before the Commission, counsel for the U.S.
Nuclear Regulatory Commission staff (Staff) hereby informs the Commission and the parties that the Staff has issued an exemption from the Commissions regulations at 10 C.F.R. § 50.47 and 10 CFR Part 50 Appendix E to Entergy Nuclear Vermont Yankee, LLC and Entergy Nuclear Operations, Inc. (the licensee), to be effective as of April 15, 2016. This action is being taken in response to the licensees exemption request dated March 14, 2014.1 Pursuant to the exemption, the licensee is no longer required to maintain formal offsite radiological emergency plans at Vermont Yankee Nuclear Power Station (VY) but will be required to maintain certain onsite capabilities to communicate and coordinate with offsite emergency response authorities.

In SECY-14-0125, the Staff asked Commission for approval to grant the exemption and in SRM-SECY-14-0125, the Commission gave its approval.2 On August 4, 2015, counsel for the Staff notified the Commission that the Staff had issued a Final Environmental Assessment and a Finding of No Significant Impact for the exemption request and had forwarded the documents for publication in the Federal Register.3 On December 2, 2015, counsel for the Staff notified the Commission of the Staffs intention to make a final no significant hazards consideration determination and issue a license amendment that will revise the VY site emergency plan and emergency action level scheme and reduce the scope of offsite and onsite emergency planning at VY.4 The cover letter accompanying the exemption, the copy of the exemption transmitted to the Federal Register for publication, and the accompanying safety evaluation report will be made available to the public through ADAMS at Accession No. ML15180A054.
