Your letter dated December 2, 1983, took exception to our Class III fee determination made for your March 17, 1983 application for Technical Specification changes relating to startup transformers and allowable degraded conditions for the Oconee Nuclear Station Unit Nos. 1, 2 and 3.

When the application was filed, you determined that fees were not due because your application supplemented a February 10, 1983 request and the technical review was conducted as a result of generic issue B-48, Adequacy of Steam Electric Distribution Voltage. Our November 15 letter requested a Class III fee and two Class I fees since the Division of Licensing (DL) staff informed us that the review would involve consideration of a single safety issue for an item not contained in your February 10 application and would apply to all units. Your letter of December 2, 1983, further stated that no license fees were justified for this request since it resulted from a written Commission request, has only minor safety significance, and may be exempt from fees (Footnote 2 to 10 CFR 170.22).

On March 2, 1984, the DL staff completed their review of your application and issued Amendment Nos. 127, 127 and 124 to License Nos. DPR-38, DPR-47, and DPR-55. Although these changes were requested by the NRC, they are not exempt under Footnote 2 of 10 CFR 170.22 since they were not requested for the convenience of the Commission. According to the written records for this case, they were requested to prohibit the use of one startup trans former for more than one unit since your voltage analysis indicated that the distribution voltages at the safety buses were unacceptable when one unit startup transformer is shared between two units.

It is the DL staff's final position that the previously determined Class III fee and two Class I fees are appropriate for this plant-specific review.

Therefore, you are requested to remit the sum of $4,800 to this office.
