NOTICE OF VIOLATION Duke Energy Corporation Docket No. 50-269,270,287 Oconee 1, 2 and 3 License No. DPR-38, 47, 55 During an NRC inspection conducted from November 29, 1998, to January 16, 1999, a violation of NRC requirements was identified. In accordance with the "General Statement of Policy and Procedures for NRC Enforcement Actions," NUREG 1600, the violation is listed below:

Technical Specification 6.4.1.1 requires the station be maintained in accordance with approved procedures and that written procedures with appropriate checkoff lists and instructions be provided for fire protection program implementation.

Nuclear Station Directive (NSD) 316, Revision 1, Section 316.5.5, "Personnel and Supervision Responsible for Performing a Fire Watch," states that a continuous fire watch requires surveillance of the affected area at least once per 15 minutes during the entire time of the impairment.

Contrary to the above, on December 10, 1998, the licensee failed to properly implement procedural requirements for conducting a continuous fire watch. A fire watch left the affected turbine building continuous fire watch area unattended for longer than 15 minutes.

This is a Severity Level IV violation (Supplement 1).

The NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence and the dates when full compliance will be achieved are already adequately addressed on the docket in this report.

However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position. In that case, or if you choose to respond, clearly mark your response as a "Reply to a Notice of Violation," and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555, with a copy to the Regional Administrator, Region 11, and a copy to the NRC Resident Inspector at Oconee, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

If you contest this enforcement action, you should also provide a copy of your response to the Director, Office of Enforcement, U. S. Nuclear Regulatory Commission, Washington, D.C.
