RESPONSE TO MARCH 23,1999 LETTER TO NRC
Dear Mr. McCollum:
This responds to the letter of March 23, 1999, from Duke Energy Corporation (DEC) to the NRC concerning the upcoming NRC inspection of Emergency Operating Procedures at the Oconee Nuclear Station. Your letter requests that the NRC concur that the planned inspection will be based on the Oconee licensing basis as described in the attached. paper. While we agree our Inspection must be based on the licensing basis for the Oconee Nuclear Station, we are not clear, at this point, that the licensing basis is as described in your letter and attachment.
To resolve this matter, we are first reviewing the NRC understanding of the licensing basis.
Next, we propose that we discuss our understanding in a meeting with you on June 30,'1999, at NRR. The information you provided will be useful during that discussion. After the meeting, we will provide you a final answer to your question. The meeting discussion must be guided by certain topics that need a "shared understanding" prior to the inspection. In this regard, we propose the following topics:
- 1.
The licensing basis for the EOPs at the Oconee Nuclear Station.
- 2.
The acceptable method of evaluating and resolving differences between your EOPs and generic ones from the B&W Owners Group Guidelines.
- 3.
The scope and objective of the NRC EOP inspection.
In accordance with Section 2.790(a) of the NRC's "Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter and its enclosures will be placed in the NRC Public Document Room.
