SUMMARY

OF JULY 28, 1999, MEETING WITH BGE AND DUKE REGARDING LICENSE RENEWAL ACTIVITIES FOR CCNPP AND ONS On July 28, 1999, the U. S. Nuclear Regulatory Commission (NRC) staff held a public meeting with representatives of BGE and Duke at Rockville, Maryland, to discuss the status of the NRC's review of BGE's and Duke's license renewal applications (LRA) for the CCNPP Units 1 and 2 and the ONS Units 1, 2, and 3. Enclosure 1 to this meeting summary provides a list of the meeting attendees. Enclosure 2 provides a copy of slides that were used by the NRC, BGE, and Duke staff to summarize the status of the review of BGE's and Duke's LRAs.

Highlights from the BGE portion of the meeting:

The meeting began with a summary of BGE's objectives for the meeting which are given on page two of the BGE presentation slides. BGE then stated that they had responded to the safety evaluation report (SER) open and confirmatory items and provided comments on the accuracy of the SER as requested by the staff. BGE added that it was their intention to submit by the end of August 1999 three examples of how they would update the final safety analysis report for three systems in order to begin discussions with the staff regarding open item 3.0-1.

BGE also provided their recommendation for the to resolve open item 3.0-1, related to the changes affecting the updated final safety analysis report supplement, that outlined on page six of their presentation slides. BGE concluded their remarks by summarizing what milestones had been completea since the last management meetirg.

The NRC stated that the staff was currently review,ing B-IE's responses to open and confirmatory items idcentified in the March 21, 19.99, -afcty evaluation report (SER), changes to BGE's license renewal application, and comments subirr.tted by BGE regarding the accuracy of the SER. The NRC also summarized the current status of open and confirmatory items identified in the SER based on BGE's responses (by letter dated July, 2, 1999). The NRC then stated that the staff would attempt to provide formal feedback to BGE by mid-August regarding any SER open and confirmatory items that would warrant any further action, as well as attempt to identify if there are any issues identified as a result of BGE's changes to their license renewal application or the comments BGE made regarding the accuracy of the SER.

BGE stated that they had a concern regarding whether resolution of open item 3.0-1 would be predicated for final issuance of a renewed license because of the possibility of its closure becoming an iterative process. The NRC stated that it did not believe the final safety analysis report changes would necessarily preclude the issuance of a renewed license; however, the NRC added that internal discussions were currently ongoing regarding the form and content of a renewed license and that this issue would also be addressed. The NRC then stated that the staff is continuing to look for opportunities to shorten its review schedule, but that at this time the staff was not prepared to change the November milestone.

- 1 4 August 19, 1999 The NRC also explained that BGE would be formally notified of any open or confirmatory items that require any further action to ensure that these activities would be tracked to closure. In addition, the NRC indicated that meetings would be arranged to clarify the basis for closure of the open and confirmatory items, and to discuss the form and content of the new license and the basis for the Commission's decision on the renewal application. Together, these activities will provide a clear plan to complete the review of the renewal application so that all parties clearly understand assigned tasks and the basis for the recommendation to the Commission.

BGE asked the NRC if there had been any new and significant information identified as the result of the public comments on the draft supplemental environmental impact statement. The NRC stated that at this time it was not aware of any such information; however, the NRC stated it would notify BGE as soon as possible if any did come to the staffs attention. BGE asked if NRC Region 1 planned to do another inspection before issuance of a renewed license and asked if a milestone was appropriate to determine whether any additional inspections would be required. The NRC stated that a milestone was appropriate and that the need for another inspection would be discussed with NRC Region 1 management. Both BGE and the NRC agreed that a tentative date for this decision should be the August management meeting. BGE then asked if another advisory committee on reactor safeguards (ACRS) meeting regarding the BGE license renewal application would be required. The NRC stated that the staff would go back to the ACRS in order to obtain a final letter regarding the final SER.

Highlights from the Duke portion of the meetinq:

The staff noted that the public meeting on the draft supplemental environmental impact statement (SEIS) had been held on July 8, 1999. The staff also noted that the comment period on the draft SEIS ends on August 16, 1999, which is in accordance with the milestone schedule for the ONS LRA review. Regarding the safety portion of the review, the staff noted that the next major milestone is the completion of responses to the ONS SER open items. Duke is to complete its responses by October 15, 1999. The staff and Duke noted that they expect continued meetings to resolve SER open items.

The staff noted that a tracking system had been developed fcr the c!osure o the SER open items. Enclosure 2 contains the tracking status as of July 16, 1,99, or the open items. The staff stated that it hoped Duke would prioritize the SER open itsms t: help the staff with resource allocation associated with the resolution of the issuec,. The staff noted that there were several areas that have already been identified that require management's attention. These areas were the following: 10 CFR Part 54 scoping issue, resolution cf open items associated with BAW-2248 (reactor vessel internals), buried piping, containment tendon trend lines, and fatigue related issues. For the 10 CFR Part 54 scoping issue, the staff stated that the preliminary assessment of Duke's June 22, 1999, response to this issue is that it resolved the first part of t' 3 SER open item (SER open item 2.1.3.1-1). The staff stated that it was evaluating the need for a meeting or audit in order to resolve the second part of the open item related to this issue.

Regarding resolution of open items associated with BAW-2248, the staff noted that a meeting had been held on July 19, 1999, to discuss resolution of the draft safety evaluation (SE) open items on the topical report. The staff and Duke noted that all but one of the draft SE open items were addressed adequately by the Owner's Group. The one issue that needed an additional submittal from the Owner's Group was the void swelling item. The staff and Duke noted that they expected further discussions on this issue and on cast austenitic stainless steel (CASS),

which is related to the topical report draft SE. The staff noted that a meeting had been August 19, 1999 tentatively scheduled for August 24, 1999, to discuss CASS related issues. Duke stated that a follow-on meeting to the July 19, 1999, meeting may be needed in order to ensure that all of the issues associated with BAW-2248 are resolved.

The staff noted that it owed Duke feedback on the SER open items related to buried piping (SER open item 3.1.3.1.7.4-1) and the containment tendon trend lines (SER open item 4.2.2.3-1). The staff also noted that a meeting to discuss issues associated with fatigue related SER open items was tentatively scheduled for August 25, 1999.
