NOTICE OF VIOLATION: RESPONSE TO DENIAL (NRC INSPECTION REPORT NO. 50-269.270,287/98-03)
Dear Mr. McCollum:
We have completed our review of your response of June 4, 1998, to the Notice of Violation issued on May 4, 1998, concerning activities conducted at your Oconee facility. In your response, you denied Violations 98-03-01 and 98-03 02, and agreed with Violation 98-03-07.
After careful consideration of your basis for denial of Violation 98-03-01.
inadequate implementation of the timeliness requirements for reporting design basis events or conditions, we have concluded that a further review is necessary. We will inform you of our disposition of this issue at a later date.
After careful consideration of your basis for denial of Violation 98-03-02. we have concluded that a violation of station Technical Specifications (TS) did occur as stated in the Notice of Violation dated May 4, 1998. Your method of flow testing of the Penetration Room Ventilation System (PRVS) was not consistent with the industry standard specified in TS, ANSI N510-1975, and therefore not in compliance with the TS. Of particular concern was that you did not adhere to the TS, did not identify or evaluate this non-conformance, and did not have a calibrated alternative method of flow measurement in use.
Although the orifice-differential pressure (dp) method currently used at Oconee for flow measurement of the PRVS may provide adequate accuracy and repeatability, there was no justification, by analysis or testing., to demonstrate the equivalency or acceptability of this method instead of the traverse pitot tube method specified by ANSI N510-1975. Further, there was no documentation to demonstrate that the vendor installed orifice was calibrated with a pitot traverse tube as required by section 9.5 of the ACGIH Industrial Ventilation standard referenced in your violation response. Your response states that the traverse pitot tube method accuracy was unfavorable in the low velocity regimes, i.e. less than 1000 feet per minute (fpm). The threshold statement in ANSI N510-1975 stated alternate methods to the traverse pitot tube could be used if no velocity is above 1000 fpm. However, you also stated that at minimum design flow volume of 900 cubic feet per minute (cfm) the flow velocity was 1150 fpm. At maximum design flow of 1100 cfm, the flow velocity would be approximately 1405 fpm. These flow velocity values of 1150 to 1405 9807160092 980706 DR ADOCK 05000269 QPDR.

fpm which are required to comply with TS are clearly above the 1000 fpm threshold of ANSI N510-1975.. This was above the threshold for alternate methods referenced in ANSI N510-1975. You also stated that some flow velocities in the duct traverse would be below the 1000 fpm threshold. The variation in flow velocity across the duct traverse is an expected phenomenon and accounted for by averaging the measured velocities across the traverse.
Although your response challenges the accuracy of the traverse pitot tube method, you have not demonstrated by analysis or testing that the orifice-dp method is equal or better in accuracy.
We have evaluated your response to Violation 98-03-07, incorrect and non conservative assumptions used in calculations for control room operator dose, and found that, with one exception, it meets the requirements of 10 CFR 2.201.
Your corrective actions did not address extent of condition. Your response did not state that other calculations were checked to ensure that they did not also contain incorrect and nonconservative assumptions. As we discussed by telephone on June 30, 1998, please supplement your response to Violation 98 03-07 to address your assessment of the extent to which incorrect and non conservative assumptions were used in other calculations.
You are required to respond to this letter addressing your corrective actions for violation 98-03-02 and the actions specified above for violation 98-03-07.
This response is required to be submitted within 30 days of the date of this letter.
In accordance with 10 CFR 2.790 of the NRC's Rules of Practice," a copy of this letter and your response will be placed in the NRC Public Document Room (PDR).
