PROPOSED IMPOSITION OF CIVIL PENALTIES -

$125,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalties in the amount of $125,000 will be issued on or about February 3, 1992 to Duke Power Company. This action is based on two Severity Level III problems related to a degradation of decay heat removal event and an over-pressurization of Low Pressure Injection System piping event. The I~irst Severity Level III problem (associated with the first event) involves multiple examples of failure to follow procedures and inadequate procedures and the failure to identify the non-operational status of a nuclear safety-related system. The base civil penalty was escalated by 50 percent based on the licensee's poor prior performance, thereby resulting in a $75,000 civil penalty. The second Severity Level III problem (associated with the second event) involves multiple examples of failure to follow procedures and the failure to take corrective action. The base civil penalty was mitigated by 50 percent based on the licensee's corrective action to prevent recurrence and escalated by 50 percent based on the licensee's poor prior performance.

Therefore, on balance, a base civil penalty of $50,000 is proposed for this Severity Level III problem.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

Mailing of Notice February 3, 1992 Telephone Notification of Licensee February 3, 1992 The State of South Carolina will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
