Dear Mr. Boozer:

Duke Energy Corporation has submitted an application to the United States Nuclear Regulatory Commission (NRC) to renew the operating licenses for Oconee Nuclear Station Units 1, 2, and 3 (Oconee). The current licenses for Units 1, 2, and 3 expire on February 6, 2013; October 6, 2013; and July 19, 2014, respectively. The renewed licenses would authorize the applicant to operate for an additional twenty years beyond the current forty-year license.

The proposed action, renewal of the operating licenses for Oconee, is a major Federal action significantly affecting the quality of the human environment. As such, the NRC must prepare an Environmental Impact Statement under the National Environmental Policy Act of 1969, as amended. Although the licensee may be in full compliance with environmental quality standards and requirements of the Clean Water Act, the NRC must still assess the environmental impacts of renewing the operating licenses for Oconee. This assessment will include water quality impacts and consider alternatives to the proposed action that are available for reducing any adverse impacts. If an environmental assessment of aquatic impacts is available from the permtting authority, the NRC will consider the assessment in its determination of the magnitude of the environmental impacts in striking an overall benefit-cost balance.

Lance Vail of the Pacific Northwest National Laboratory, a contractor for NRC staff, and members of the NRC staff have had several consultations with Melinda Vickers and Ann Lackey of your staff. This is a formal request for SCDHEC to provide the NRC with information on 1) the current status of the NPDES and land disposal permits for the Oconee Nuclear Station and 2) any other information that the NRC should be aware of regarding water quality issues that are likely to impact the ability of the plant to continue to operate to 2034.
