APPENDIX A NOTICE OF VIOLATION Duke Power Company Docket Nos. 50-269, 50-270 & 50-287 Oconee 1, 2 and 3 License Nos. DPR-38, DPR-47 & DPR-55 As a result of the inspection conducted on November 5, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980),

the following violation was identified.

A.

10 CFR 71.12 requires that persons delivering licensed material to a carrier for transport in a package for which a certificate of compliance has been issued comply with the terms and conditions of the license, certificate or other approval. Certificate of Compliance Number 9010, Revision 7, states that the NLI-1/2 shipping cask cavity and containment vessel (inner con tainer) shall have no free water when delivered to a carrier for transport.

Contrary to the above, the terms and conditions of the certificate of compliance were not met in that on November 3, 1981, the NLI-1/2 cask was delivered to a carrier for transport with approximately 65 gallons of water inside the cask cavity.

This is a Severity Level IV Violation (Supplement V).

Pursuant to the provisions of 10 CFR 2.201, you are hereby required to submit to this office within thirty days of the date of this Notice, a written statement or explanation in reply, including: (1) admission or denial of the alleged viola tion; (2) the reasons for the violation if admitted; (3) the corrective steps

.which have been taken and the results achieved; (4) corrective steps which will be taken to avoid further violations; and (5) the date when full compliance will be achieved. Consideration may be given to extending your response time for good cause shown.

Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.

The responses directed by this Notice are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
