With your application dated November 7, 1980 (which was filed with\\
tfe of Nuclear Reactor Regulation (ONRR) for review), your Company remited 4,80b in fees per 10 CFR 170.22 for a Class III and two Class I type actions application proposed certain Technical Specifications changes for survei requirements for valves (LP-17 & LP-18) for the three units at the Oconee Station.
On April 20, 1981, the ONRR staff issued an Order which incorporated the issue addressed in your November 1 application. It is our understanding that the ONRR staff had completed their technical review of the issue 6efore your appli cation was filed and that the April 20 Order was irrespective of your having filed this application. On.this basis, it has been determined that an exemption pursuant to 10 CFR 170.11(b) from the fee requirements of 10 CFR 170.22 is author ized by law, and such exemption is otherwise in the public interest and is hereby granted for your application dated November 7, 1980. Therefore, we have concurrently authorized the Office of the Controller to refund to your Company the $4,800 paid for this application. Refunds are generally processed by the Office of the Controller within a two-week period.
