Gentlemen:
Thank you for your letter of December 27, 1979, informing us of steps
you have taken to correct the items of noncompliance concerning activities
under NRC Operating License No. DPR-55 brought to your attention in our
letter of December 6, 1979.
With regard to your response to the item of noncompliance concerning
releases from a restricted area, we have reviewed your arguments
supporting a contention that the sewage treatment sump is within a
restricted area. It should be noted that a restricted area must meet
the criteria stipulated by 10 CFR 20.3(14), i.e., access must be
controlled for the purpose of protection of individuals from exposure
to radiation or radioactive materials. In addition, other requirements
of 10 CFR applicable to restricted areas must be met, such as require
ments for the posting of notices and instructions to workers stipulated
by 10 CFR 19.11 and 19.12. Based on these criteria, it seems apparent
that the sewage treatment system was not in a restricted area. Further
more, in correspondence to the NRC dated January 4, 1978, concerning
storage of radioactive material in warehouse no. 4, you included a map
defining the restricted area at Oconee Nuclear Station. This area is
bounded by the protected area fence and meets the criteria specified
above. The parking lot area, where the sewage treatment system is
located, is outside the identified restricted area. Therefore, the
item of noncompliance appears to be correct as cited.
As your response to the items of noncompliance concerning adherence
to procedures and review of system modifications included immediate
actions and corrective steps to prevent future similar releases of
radioactivity to the sewage treatment system sump, no further response
on your part is required. We will examine these corrective actions
and plans during subsequent inspections.
