Reference:

Letter from Duke Energy to NRC dated February 22, 2012, Agency Wide Document Access and Management System (ADAMS) Accession No.ML12061A008, as supplemented by letters dated November 13, 2012, ADAMS Accession No. ML12340A073 and February 4, 2013, ADAMS Accession No.ML13045A307 The reference letters submitted a LAR to revise TS 3.7.7 for McGuire Units 1 and 2. The LAR would allow the use of the NSWS Pump discharge crossover valves and associated piping to cross-tie Unit 1 and 2 NSW systems for mitigation of a loss of service water event on either unit.Following the February 4, 2013 submittal, the Nuclear Regulatory Commission staff indicated that additional information would be needed to continue with the review of this LAR. Additional conversations were held with the NRC to better understand the NRC's concerns.

These conversations indicated that the concerns probably could not be resolved by the proposed Technical Specification change that was prepared in accordance with the direction given in Generic Letter (GL) 91-13, "Request for Information Related to the Resolution of Generic Issue 130, 'Essential Service Water System Failures at Multi-Unit Sites', Pursuant to 10 CFR 50.54" and response to beyond design basis (BDB) events. Additionally, these conversations indicated that there was clearly no path forward from a purely deterministic approach.Although there is no requirement for McGuire to include the guidance for cross-tying the NSWS discharge paths in the Emergency Operating Procedures (EOP)s and/or Abnormal Procedures (AP)s, inclusion of this guidance in procedures immediately available to the control room operators rather than in Severe Accident Mitigation Guidelines (SAMG)s will reduce nuclear safety risk.oo0I U. Nuclear Regulatory Commission July 29, 2015 Page 2 For this reason, McGuire plans to submit a new LAR for use of the NSWS Pump discharge crossover valves and associated piping to cross-tie Unit 1 and 2 NSW systems for mitigation of a loss of service water event on either unit utilizing the NRC-endorsed industry guidance titled"Change Process with respect to BDB applications", ADAMS Accession No. ML14231A535.

Because there is no apparent success path for this LAR under GL 91-13, Duke Energy hereby withdraws the LAR so that the approach described above may be pursued.This letter contains no new Regulatory Commitments and no revision to existing Regulatory Commitments.
