MCGUIRE GENERATING STATION, UNIT NOS. 1 AND 2 -WITHDRAWAL OF AN AMENDMENT REQUEST RE: REVISION TO TECHNICAL SPECIFICATION 3.7.7, "NUCLEAR SERVICE WATER SYSTEM" (TAC NOS. ME8118 AND ME8119)
Dear Mr. Capps:
By letter dated February 22, 2012 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML12061A008), as supplemented by letters dated November 13, 2012 (ADAMS Accession No, ML12340A073), and February 4, 2013 (ADAMS Accession No. ML13045A307), Duke Energy Carolinas, LLC submitted a license amendment request (LAR) for U.S. Nuclear Regulatory Commission (NRC) approval to revise the McGuire Nuclear Station Technical Specification (TS) 3.7.7, "Nuclear Service Water System." Specifically, the amendment would have added an allowed outage time for the purpose of mitigating a loss of service water event on one unit with water from the other unit. A notice of the NRC's consideration of issuance of the proposed amendment was published in the Federal Register on July 10, 2012 (77 FR 40650).
Subsequently, by letter dated July 29, 2015 (ADAMS Accession No. ML15212A731), you requested to withdraw the amendment request.
In your letter, you indicated your intent to subsequently submit a new LAR that, as a basis, would use the NRG-endorsed industry guidance titled "Change Process with respect to BOB applications" (ADAMS Accession No. ML14231A535).. The NRC staff notes that the endorsement was in reference to compliance with Order EA-12-049, "Mitigation Strategies of Beyond-Design-Basis External Events." As such, the NRC staff would encourage a pre-application meeting with Duke to discuss the format and content of the proposed LAR and ensure the appropriate context of the of the referenced guidance.
The NRC staff has ceased all work on this licensing action and closed Technical Assignment Control (TAC) Nos. ME8118 and ME8119. The NRC has filed the enclosed Notice of Withdrawal of Application for Amendment to Facility Operating License with the Office of the Federal Register for publication.

SUMMARY
- The U.S. Nuclear Regulatory Commission (NRC) has granted the request of Duke Energy Carolinas, LLC to withdraw its application dated February 22, 2012, as supplemented by letters dated November 13, 2012 and February 4, 2013, for a proposed amendment to Renewed Facility Operating License Nos. NPF-9 and NPF-17, for the McGuire Nuclear Station, Units 1 and 2. The proposed amendment would have revised the McGuire Technical Specification 3.7.7, "Nuclear Service Water System (NSWS)." Specifically, the proposed change would have the use of the NSWS pump discharge crossover valves and associated piping to cross tie McGuire Nuclear Stataion Units 1 and 2 NSWS trains to mitigate a Loss of Service Water event.

The NRC has granted the request of Duke Energy Carolinas, LLC (the licensee) to withdraw its application dated February 22, 2012 (ADAMS Accession No. ML12061A008), for a proposed amendment to the McGuire Nuclear Station, Units 1 and 2, located in York County, North Carolina.
