NOTICE OF VIOLATION

(NRC INSPECTION REPORT NOS. 50-269/98-03, 50-270/98-03,

50-287/98-03)

Dear Mr. McCollum:

The Nuclear Regulatory Commission (NRC) conducted a Safety System Engineering

Inspection (SSEI) at your Oconee 1, 2, and 3 reactor facilities during

March 2 - 6 and March 16 - 20, 1998. The primary objective of this SSEI was

.

to assess the calculations, analyses, and other engineering documents that

were used to support control room ventilation system (CRVS) and penetration

room ventilation system (PRVS) performance during normal and accident or

abnormal conditions. The enclosed report presents the results of that

inspection.

Based on the results of this inspection, the NRC has determined that

violations of NRC requirements occurred. Violations were identified for

untimely reporting of design issues; incorrect and nonconservative assumptions

in control room operator dose calculations; and failure to perform penetration

room ventilation system surveillances in accordance with the Technical

Specifications. We are concerned that your procedures for operability and

reportability incorrectly allowed the untimely reporting of design issues. We

are also concerned that your engineering calculations contained significant

incorrect assumptions.

These violations are cited in the enclosed Notice of Violation, and the

circumstances surrounding the violations are described in detail in the

enclosed report. Please note that you are required to respond to this letter

and should follow the instructions specified in the enclosed Notice when

preparing your response. The NRC will use your response, in

part, to

determine whether further enforcement action is necessary to ensure compliance

with regulatory requirements.

In addition, two apparent violations were identified and are being considered

for escalated enforcement action in accordance with the "General Statement of

Policy and Procedures for NRC Enforcement Actions" (Enforcement Policy),

NUREG-1600. The apparent violations involve a safety evaluation for a 1984

modification to the Unit 1 and 2 control room ventilation system and a 1997

Updated Final Safety Analysis Report (UFSAR) change for that modification.

Accordingly, no Notice of Violation is presently being issued for these

inspection findings. In addition, please be advised that the number and

characterization of the apparent violations described in the enclosed

inspection report may change as a result of further NRC review.

A predecisional enforcement conference to discuss these apparent violations

has been scheduled for 10:00 a.m.-EDT on May 19, 1998, in the NRC Region II

Office. The decision to hold a predecisional enforcement conference does not

mean that the NRC has determined that a violation has occurred or that

enforcement action will be taken. This conference is being held to obtain

information to enable the NRC to make an enforcement decision, such as a

common understanding of the facts, root causes, missed opportunities to

identify the apparent violation sooner, corrective actions,-significance of

the issues, and the need for lasting and effective corrective action. In

particular, we expect you to address how your corrective action process and a

UFSAR change missed opportunities in 1997 to identify and correct a single

failure vulnerability related to the ventilation for the cable rooms. Your

letter of April 12, 1995, described a plan to review quality assurance (QA)

classifications for all non-safety related equipment relied upon to mitigate a

design basis accident. Please address why that review failed to change the QA

classification of the cable room ventilation to QA-1 (safety-related) or to

identify and correct the single failure vulnerability. In addition, this is

an opportunity for you to point out any errors in our inspection report and

for you to provide any information concerning your perspectives on 1) the

severity of the violation, 2) the application of the factors that the NRC

considers when it determines the amount of a civil penalty that may be

assessed in accordance with Section VI.B.2 of the Enforcement Policy, and 3)

any other application of the Enforcement Policy to this case, including the

exercise of discretion in accordance with Section VII.

The conference will be open to public observation in accordance with Section V

of the Enforcement Policy (Enclosure 3).

You will be advised by separate correspondence of the results of our

.

deliberations on this matter. No response regarding these apparent violations

is required at this time.
