KEWAUNEE POWER STATION -TERMINATION OF EMERGENCY RESPONSE DATA SYSTEM FEED TO THE U.S. NUCLEAR REGULATORY COMMISSION

Dear Mr. Heacock:

This letter serves to acknowledge the termination of the Emergency Response Data System (EROS) by Dominion Energy Kewaunee, Inc. (DEK), including the data link from the Kewaunee Power Station (KPS) to the U.S. Nuclear Regulatory Commission (NRC) Operations Center, as the plant parameters collected are not relevant to assessing the condition of a facility that is permanently shut down and defueled.

Section VI of Appendix E to Part 50 of Title 10 of the Code of Federal Regulations (10 CFR) establishes the requirement for a nuclear power reactor licensee to have a real-time electronic data link from the licensee's onsite computer system to the NRC Operations Center that provides for the automated transmission of a limited data set of selected parameters. However, Section Vl.2 of Appendix E to 10 CFR Part 50 specifically exempts from the requirement to maintain the EROS data link with the NRC those nuclear power facilities that have permanently or indefinitely shut down.

By letter dated February 25, 2013 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML13058A065), DEK submitted to the NRC a certification, under 10 CFR 50.82(a)(1 )(i), indicating its intention to permanently cease power operations at KPS.

On May 7, 2013, the KPS reactor permanently ceased power generation. After the reactor was shut down, all fuel assemblies were removed from the reactor vessel and placed in the spent fuel pool. On May 14, 2013, DEK submitted a certification of permanent removal of fuel from the KPS reactor vessel under 10 CFR 50.82(a)(1 )(ii) (ADAMS Accession No. ML13135A209).

Upon docketing of these certifications, the 10 CFR Part 50 license for KPS no longer authorizes operation of the reactor or emplacement or retention of fuel into the reactor vessel, as specified in 10 CFR 50.82(a)(2). As such, DEK has subsequently revised KPS's procedures under 10 CFR 50.54(q) to remove the requirement to activate the EROS data transmission within 1 hour1.157407e-5 days <br />2.777778e-4 hours <br />1.653439e-6 weeks <br />3.805e-7 months <br /> of an emergency declared as an Alert (the highest emergency classification at KPS). 1 Requirements for the maintenance and use of EROS by licensees who have submitted certification of permanent cessation of operations pursuant to 10 CFR 50.82, "Termination of Licensees," are described in a letter dated June 2, 2014, from Robert J. Lewis to NRC Regions (ADAMS Accession No. ML14099A520).

D. Heacock Based on the certification of the permanently shut down and defueled condition of the KPS reactor, and the removal of the commitment to transmit EROS data from the KPS emergency plan and procedures, the NRC acknowledges that KPS is no longer required to maintain EROS in accordance with Section Vl.3 of Appendix E to 10 CFR Part 50. Any NRC provided hardware or software in support of the EROS link should be returned to the NRC within 90 days of the date of this letter.
