KEWAUNEE POWER STATION-DENIAL OF REQUEST F_OR EXEMPTIONS FROM CERTAIN REQUIREMENTS OF 10 CFR 73.55 (TAC MF3012)

Dear Mr. Heacock:

By letter dated October 8, 2013, Dominion Energy Kewaunee, Inc. (DEK) submitted a request for exemptions from certain requirements of Title 10 of the Code of Federal Regulations 10 CFR 73.55 pursuant to 10 CFR 73.5 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML13290A154). Your request was supplemented by a letter dated April 11, 2014 (ADAMS Accession No. ML14104A885) in response to a U.S. Nuclear Regulatory Commission (NRC) staff request for additional information. Attachments to both your original October 8, 2013, request and April 11, 2014, supplemental information contain safeguards information and accordingly, have been withheld from public disclosure.

After careful review, the NRC staff has concluded that DEK's proposed alternative measures for protection against radiological sabotage, which would be implemented in conjunction with the requested exemptions, will not meet the performance objectives of 10 CFR 73.55(b).

Specifically, DEK did not demonstrate that the proposed changes to the Kewaunee Power Station physical security plan, based on the requested exemptions, would maintain detection, assessment, and communications capabilities required to protectthe facility against a design basis threat of radiological sabotage. Therefore, pursuant to 10 CFR 73.5, the NRC staff has determined that granting the proposed exemptions would be inimical to the common defense and security and constitut~ an unreasonable risk to public health and safety. Consequently, your exemption requests are denied.
