TEMPORARY WAIVER OF COMPLIANCE - H. B. ROBINSON STEAM ELECTRIC STATION, UNIT NO. 2 (TAC NO. 77728)

By letter dated October 5, 1990, you requested an emergency Technical Specification (TS) Amendment related to Technical Specification 3.5.3.3, Table 3.5-7, Items 3.a and 3.b, Required Action b. for the H. B. Robinson Steam Electric Station, Unit No. 2 (HBR-2). Your proposed emergency TS amendment would add a footnote to Action b. This proposed footnote would provide a one time change during Refueling Outage 13 to allow continued effluent releases (purging from the reactor containment vessel) with radiation monitors RMS-11 and RMS-12 and their associated backup monitors RMS-14 and RMS-34 out of service. The amendment would allow containment purging only with no fuel in containment and containment integrity not required.

We have reviewed the Request for Temporary Waiver of Compliance in your October 5, 1990, letter and find it acceptable. Therefore, we confirm the requested Temporary Waiver of Compliance, which was verbally granted on October 5, 1990. A marked-up TS 3.5.3.3, Table 3.5-7, Item 3.a and 3.b.

with the footnote for HBR-2 is enclosed. This Temporary Waiver of Compliance shall be effective immediately and shall remain in effect until the NRC staff completes processing of Carolina Power & Light Company's request for an emergency TS Amendment dated October 5, 1990.
