REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE, H. B. ROBINSON STEAM ELECTRIC PLANT, UNIT 2 (TAC NO. M98953)
By letter dated October 14, 1997, Carolina Power and Light Company (CP&L) submitted a document, prepared by Siemens Power Corporation (Siemens) EMF-94-157(P), "H. B.
Robinson Unit 2 Extended Transfer to Cold Leg Recirculation Following a Large Break LOCA,"
Proprietary, dated September 1994, to the NRC. In addition, CP&L submitted a non-proprietary version of this same document, designated EMF-94-157. Included in CP&L's submittal was your affidavit, September 25, 1997, requesting thatthe information in the report not be disclosed or divulged.
You stated that the submitted information in EMF-94-157(P) should be considered proprietary for the following reasons:
- 1.
Disclosure of the proprietary information contained in the document would permit a competitior to reduce its expenditure of money and manpower and to improve its competitive position by giving insight into Siemens licensing methodology and would thus result in harm to Siemens competitive position.
- 2.
The document contains information, which reveals certain distinguishing aspects of Siemens licensing methodolgy which secure competitive advantage to Siemens for fuel design and marketability. You also stated that this information is used by Siemens in its business and affords Siemens an opportunity to obtain a competitive advantage over its competitors who do not know or use the information.
In your affidavit, you stated that the information is of the type customarily held in confidence by Siemens and not made available to the public and that the information has in fact been held in confidence and is not available in public sources. You further stated that the report was made available to the U.S. Nuclear Regulatory Commission in confidence.
We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements, have determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.
Therefore, your report, EMF-94-157(P), "H. B. Robinson Unit 2 Extended Transfer to Cold Leg Recirculation Following a Large Break LOCA," Proprietary, dated September 1994, will be 9811200308 981117 PDR ADOCK 05000261 P

In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
