CLOSEOUT OF TAC NO. M98709 - REQUEST FOR EXEMPTION FROM 10 CFR 70.24(a), CRITICALITY ACCIDENT REQUIREMENTS H. B. ROBINSON STEAM ELECTRIC PLANT, UNIT NO. 2

Dear Mr. Young:

This is in reference to your exemption request dated April 23, 1997, as supplemented by letter dated August 27, 1997. In your application, you requested exemption from certain requirements of 10 CFR 70.24(a), "Criticality Accident Requirements."

The Nuclear Regulatory Commission (NRC) is amending its regulations relating to criticality monitoring requirements for possession of more than a small amount of special nuclear materials. The final rule was published in the Federal Register November 12, 1998 (63 FR 63127), effective December 14, 1998. Please review your submittal for the exemption to determine the need for it. If you determine that the proposed exemption is no longer required, please withdraw your request or amend it as appropriate.
