NOTICE OF VIOLATION

(NRC INSPECTION REPORT NO. 50-261/89-11)

This refers to the Nuclear Regulatory Commission (NRC) Operational Safety Team

Inspection conducted by R. H. Bernhard on July 10,

- July 28,

1989.

The

inspection included a review of activities authorized for your H. B. Robinson

facility. At the conclusion of the inspection, the findings were discussed with

those members of your staff identified in the enclosed inspection report.

Areas examined during the inspection are identified in the report.

Within

these areas, the inspection consisted of selective examinations of procedures

and representative records, interviews with personnel,

and observation of

activities in progress.

The inspection findings indicate that certain activities appeared to violate

NRC requirements. The violations, references to pertinent requirements,

and

elements to be included in your response are described in the enclosed Notice

of Violation. In addition, a violation described in the enclosed inspection

report is under consideration for escalated enforcement action.

Accordingly,

no Notice of Violation for this violation is being issued at this time.

However,

please be advised that the number

and characterization of the

violation described in the report may change as a result of further NRC review.

An Enforcement Conference to discuss the violation will be scheduled at a

future date. You will be advised by separate correspondence of the results of

our-deliberations on this matter.

A number of inspection findings are identified as weaknesses. Each weakness has

been assigned an Inspector Follow-up Item Number.

To clearly define

Carolina Power and Light's plans for corrective action on the inspection

findings, we request that CP&L respond in writing to this report.

Within 30

days of the date of this letter, the NRC requests CP&L respond with a statement

of intended corrective action for each of the weaknesses and the dates that

action will be taken.

Your attention is invited to unresolved items identified in the inspection

report. This matter will be pursued during future inspections.

The team noted improvements in many areas inspected.

Plant management was

aggressively addressing long term plant performance.

However,

some issues

discussed in the report deal with areas of potential programmatic weakness.

Auxiliary Feedwater System net positive suction head concerns,

an inadequate

torquing program and freeze protection indicate a lack of adequate management

overview in directing periodic review of plant.and corporate programs.

These

matters and the other followup items identified in the report will be pursued

in future inspections.

In accordance with Section 2.790 of the NRC's "Rules of Practice." Part 2,

Title 10, Code of Federal Regulations, a copy of this letter and its enclosures

will be placed in the NRC Public Document Room.

The responses directed by this letter and its enclosures are not subject to the

clearance procedures of the Office of Management and Budget as required by the

Paperwork Reduction Act of 1980, Pub. L. No.96-511.
