NOTICE OF VIOLATION

(NRC INSPECTION REPORT NO. 50-261/86-09)

This refers to the Nuclear Regulatory Commission (NRC) inspection conducted by

Mr. R. E. Weddington at the H. B. Robinson facility on April 7-11 and May 16, 1986.

The inspection included a review of the circumstances surrounding the transpor

tation and transfer of radioactive material.

As a result of this inspection,

significant failures to comply with NRC regulatory requirements were identified

and, accordingly, NRC concerns relative to the inspection findings were discussed

by Mr. J. Philip Stohr, Director, Division of Radiation Safety and Safeguards,

NRC, Region II, with Mr. M. A. McDuffie, Senior Vice President, Nuclear Generation,

in an Enforcement Conference held on May 16, 1986.

The violations described in the enclosed Notice of Violation involved a failure

to comply with regulations applicable to the transportation and transfer of

licensed material and failure to post and control a high radiation area. The

events that resulted in these violations included radioactive waste shipments

found by the State of Washington to be improperly classified pursuant to 10 CFR

Part 61; a hole, involving leakage of package contents, found in a radioactive

waste shipment box by the State of South Carolina; and transfer of a byproduct

material sample to an Agreement State licensee in excess of its license

possession limits.

In accordance with the "General Statement of Policy and Procedure for NRC

Enforcement Actions," 10 CFR Part 2, Appendix C (1986), the violations described

in Items A, B, and C of the enclosed Notice have been classified in the aggregate

as a Severity Level III problem. Normally, a civil penalty is considered for a

Severity Level III violation or problem. However, after consultation with the

Director, Office of Inspection and Enforcement, I have decided that a civil

penalty will not be proposed in this case because of your prompt corrective

actions and because enforcement action has already been taken by the State of

South Carolina for Item B in the enclosed Notice.

Item D in the enclosed Notice

has been classified as a Severity Level IV violation.

regulatory requirements.

In accordance with Section 2.790 of the NRC's "Rules of Practice," Part 2,

Title 10,

Code of Federal Regulations, a copy of this letter and its enclosures

will be placed in the NRC Public Document Room.

The responses directed by this letter and its enclosures are not subject to the

clearance procedures of the Office of Management and Budget as required by the

Paperwork Reduction Act of 1980, PL 96-511.
