Dear Mr. Lochbaum:
June 27, 2014 The U.S. Nuclear Regulatory Commission (NRC) staff has reviewed your petition dated July 25, 2013, addressed to Mr. Bill Borchardt, Executive Director for Operations, NRC.
Subsequently, you and your co-petitioners supplemented your petition during a conference call on November 13, 2013. In your petition you requested that the NRC take an enforcement action by imposing a regulatory requirement that the condenser tubes in the James A.
FitzPatrick Nuclear Power Plant be replaced prior to return from its fall 2014 refueling outage.
The NRC staff's proposed director's decision under Title 10, "Energy," of the Code of Federal Regulations Section 2.206, "Requests for action under this subpart," is enclosed.
If you believe that portions of the decision are incorrect or do not fully address issues raised in the petition, please provide comments to me. The NRC staff is making a similar request of the licensee. The NRC staff will then review comments provided by you and the licensee and consider them in the final version of the director's decision with no further opportunity to comment.
Please provide your comments within 30 days of the date of this letter.
