Dear Mr. Coyle:
The U.S. Nuclear Regulatory Commission (NRC) staff has reviewed the petition from Mr. David Lochbaum, eta/., dated July 25, 2013, addressed to Mr. Bill Borchardt, Executive Director for Operations, NRC. Subsequently, the co-petitioners supplemented their petition during a conference call on November 13, 2013. The petitioners requested that the NRC take an enforcement action by imposing a regulatory requirement that the condenser tubes in the James A. FitzPatrick Nuclear Power Plant be replaced prior to return from its fall 2014 refueling outage.
I have enclosed the NRC staff's proposed director's decision under Title 10, "Energy," of the Code of Federal Regulations, Section 2.206, "Requests for action under this subpart," for your comments.
I request that you provide comments to me on any portions that you believe have errors or any issues in the petition that you believe have not been fully addressed. The NRC staff is making a similar request to the petitioners. The NRC staff will review all comments provided by you and the petitioners and consider them in the final version of the director's decision with no further opportunity for comments.
Please provide your comments within 30 days of the date of this letter.
