SAN ONOFRE NUCLEAR GENERATING STATION, UNITS 2 AND 3-WITHDRAWAL OF LICENSE AMENDMENT REQUEST (TAC NOS. MF1431 AND MF1432)
Dear Mr. Palmisano:
By letter dated March 27, 2013, as supplemented by letters dated April 17 and 25, and May 29, 2013 (Agencywide Documents Access and Management System (ADAMS) Accession Nos.
- ML13168A590, ML13169A005, ML13119A021, and ML13154A017, respectively), Southern California Edison Company (SCE, the licensee) submitted a license amendment request (LAR) to amend the operating licenses for Units 2 and 3 of the San Onofre Nuclear Generating Station (SONGS). The proposed amendments requested the adoption of the National Fire Protection Association (NFPA) Standard 805, "Performance-Based Standard for Fire Protection for Light.
Water Reactor Electric Generating Plants," 2001 Edition, in accordance with Section 50.48(c) of Title 10 of the Code of Federal Regulations (10 CFR 50.48(c)).
The supplements corrected formatting errors and forwarded missing pages that were identified in the original application. As a result, the U.S. Nuclear Regulatory Commission (NRC) staff*
had not completed its acceptance review of the LAR at the time SCE submitted its certification of permanent cessation of power operations for SONGS dated June 12, 2013 (ADAMS Accession No. ML131640201).
Subsequently, by letter dated November 21, 2013 (ADAMS Accession No. ML13326B005),
SCE informed the NRC that it wished to withdraw its request to transition to the NFPA 805 Standard., This letter noted, in part that:
This LAR withdrawal is based on the cessation of SONGS Units 2 and 3 power operation and retracts the commitments that were included in the referenced LAR submittal.
Accordingly, with this request to withdraw your application to transition to NFPA 805, SONGS will no longer receive enforcement discretion for certain fire protection program issues, and may be subject to enforcement action in accordance with the NRC Enforcement Policy.
In your November 2013 letter, SCE stated that SONGS had reviewed the existing fire protection program and found that foll9vying permanent shutdovtn $ysterns that-were credited to achieve and maintain safe shutdown were no longer required. Compliance with all* requirements could I~
- be achieved without reliance on unapproved Operator Manual Actions (OMAs) that were previously cited in the NRC's Trienni~l Fire Protection Inspection report (ADAMS Accession No. ML102740149). SCE also evaluated the OMAs implemented as compensatory measures and determined that they do not support spent fuel management and are no longer needed to comply with Unit 2 License Condition 2.C(14) and Unit 3 License Condition C(12). Finally, SCE stated that SONGS will continue to maintain a robust fire protection program that does not rely
. on unapproved OMAs to ensure safety of Units 2 and 3 spent fuel.
Therefore, the NRC staff acknowledges receipt of your withdrawal request. The staff has stopped work on the NFPA-805 LAR review and will close TAC Nos. MF1432 and MF1433.
Because a Notice of Considerati<;>n of Issuance for the proposed amendment had not been published in the Federal Register, no withdrawal notification in the Federal Register will be
