We have completed our review of your request dated February 8, 1988, for a permanent, partial exemption from the annual fee requirements of 10 CFR 171 for the San Onofre Nuclear Generating Station Unit No. 1 (SONGS-1). The pertinent basis for your request was mainly that SONGS-1 is one of the oldest and smallest commercial operating plants.
One intent of the exemption provisions of 10 CFR 171.11 is to permit a few small, older reactors some relief from fees if it can be demonstrated that fees would have such an economic impact that a licensee might have to discontinue operation of the reactor. While SONGS-1 is one of the oldest and smallest commercial operating plants, it is almost twice the size of the largest reactor previously granted a partial exemption. As presented in your request, the assessment of annual fees to Southern California Edison Company (SCE) for SONGS-1 will not have an adverse economic impact in that the increase in power costs to SCE and the net increase on a per customer basis are minimal.
As you have not met the criteria required for granting an exemption, we have determined that an exemption from the annual fee provisions of 10 CFR 171 is not justified or appropriate for SONGS-1. Therefore, your request is denied.
Since we did not bill SCE on April 1, 1988, for the third quarterly fee payment, enclosed for payment is Invoice No. G0854 for $234,000 for the third quarter.

In December 1987, legislation was passed which amended the Consolidated Omnibus Budget Reconciliation Act of 1985 (Public Law 99-272) and increased the total collection of fees by NRC from 33% of NRC's budget to 45% for FY 1988. Consequently, your fourth quarterly invoice will be increased to reflect the required additional FY 1988 amount to be assessed. Currently, it is estimated that the additional amount to be added to the fourth quarter invoices could be in the range of $100,000
$400,000, depending on total collections under other provisions of the law.

Interest.
Interest will accrue from the invoice date at the annual rate of 6 percent.
Payment is due on the invoice date.
However, interest will be waived if payment is received within 30 days from the invoice date.
