Dear Mr. Baskin:
Enclosed is a "Contingent Rescission of Suspension" and supporting Safety Evaluation Report pertaining to resumed operation of San Onofre Unit 1.
Operation was suspended by the "Order Confirming Licensee Commitments on Seismic Upgrading" dated August 11, 1982. The plant may resume operation in accordance with the terms of the "Contingent Rescission of Suspension."
In the enclosed Safety Evaluation Report, we concluded that there is reasonable assurance that operation of San Onofre Unit 1 in accordance with the enclosed "Contingent Rescission of Suspension" will present no undue risk to the public health and safety. The statements and responses of the staff presented at the public meeting of the Commission held on November 21, 1984 can be relied on as confirmation of this conclusion. The Safety Evaluation Report includes, as Attachment A, a technical evaluation report by our contractor, EG&G Idaho, Inc.
which notes that a few specific inspections were not conducted because of a lack of time or inaccessibility. Neither the staff nor EG&G believe that the conduct of those inspections is necessary to affirm the conclusions presented in the Safety Evaluation Report, since an adequate number of inspections were performed.
For purposes of the units' technical specifications, operability of those structures, systems, and components which have been shown to remain functional following a 0.67g seismic event, should be determined on the basis of 0.67g.
In addition, if a structure, system or component no longer satisfies this basis, reports shall be submitted in accordance with 10 CFR 50.72(b)(ii)(B) and 10 CFR 50.73(a)(2)(ii)(B) of the Commission's regulations. Similarily, if the analyses, conducted as part of the ongoing seismic evaluation, or results thereof, indicate that the seismic capability of any safety-related structure, system or component is less than 0.5g, you should submit a report in accordance with the cited regulations.
