Thank you for your letter dated October 4, 1982, which provided your additional comments to support the position that fees are not applicable to your June 25, 1982 application for San Onofre Unit No. 1. Our letter dated September 23, 1982, requested a Class II fee of $1,200 pursuant to 10 CFR 170.22 for this appli cation. It is your position that this change was for clarifica tion purposes to assure proper interpretation of a requirement by members of the NRC Office of Inspection and Enforcement.
The Division of Licensing (DL) staff have reassessed their earlier fee position on your June 25 application in light of the addi tional information provided in your October 4 letter. As a result of this fee reassessment, the DL staff agree with your fee posi tion since the application was for clarification of the Technical Specifications for the benefit of proper interpretation by NRC inspectors. Consequently, no fee is due for your June 25 appli cation.
We appreciate the additional information which was provided in your October letter.
We regret any inconvenience this fee matter might have caused you.
