We have received a copy of your applications dated September 15, 1981, January 7, 1982, and February 1, 1982, which were filed with the Office of Nuclear Reactor Regulation (ONRR) for review. The September 15 application requested an extension of the latest construction completion dates for San Onofre Nuclear Generating Station, Unit Nos. 2 and 3 and the other two applications requested extensions for Unit No. 2 only.

Three Class II fees ($3,600) and one Class I fee ($400) were remitted with these applications.

Based on information provided by the ONRR staff, it has been determined that the September 15, 1981, January 7, 1982, and February 1, 1982 applications relating to Unit 2 are exempt from the fee requirements since no review had commenced on these applications prior to the issuance of Operating License NPF-10 on February 16, 1982 for Unit No. 2. On this basis, we have concluded that an exemption, pursuant to 10 CFR 170.11(b),

from the fee requirements is authorized by law and such exemption is otherwise in the public interest and is hereby granted for the September 15, 1981, January 7, 1982, and February 1, 1982 applications-relating to Unit 2.

Therefore, a refund is appropriate.

Since the September 15 application now only involves a single unit (No. 3) and is still pending with the USNRC, we are retaining $1,200 (of the $1,600 which your Company paid) for the Unit No. 3 extension and refunding the duplicate Class I fee of $400. A total of $2,400 is subject to refund for the Unit No. 2 applications dated January 7 and February 1, 1982. Therefore, we are concurrently authorizing the Division of Accounting and Finance to refund a sum of $2,800 to your Company.
