REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (SAN ONOFRE NUCLEAR GENERATING-STATION, UNITS Z AND 3)
The Southern California Edison Company, by letter dated August 13, 1980, submitted Combustion Engineering input data used in the CESEC and TORC computer codes for analysis of several:,steam line and feedline breaks (CEN-127(S)-P) and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790. Your affidavit and a non-proprietary version of CEN-127(S)-P were also submitted with the August 13 letter.
Your reasons for requesting our withholding of this information were (1) the information has customarily been held in confidence and is not publicly available, (2) application of the data provides Combustion Engineering with a substantial competitive advantage, and.(3) public disclosure of the information would likely cause substantial harm to your competitive position.
We have reviewed your affidavit and material based on the requirements and criteria of 10 CFR 2.790 and have determined that the above-mentioned document sought to be withheld contain trade secrets or confidential or proprietary tommercial or financial information.
We also have found at this time that the right of the public to be fully apprised as to-the bases for and effects of the proposed action does not outweigh the demonstrated concern for protection of your competitive position. Accordingly, we have determined that the information should be withheld from public disclosure.
We therefore approve your request for withholding pursuant to Section 2.790 of 10 CFR Part 2 and are withholding CEN-127(S)-P from public inspection as proprietary.
Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents.
If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, assure that the consultants have signed t aparopri e agreements for handliny proprietary data.
- 2 If the basis for.withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC.
