SU JCT: REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (San Onofre Nuclear Generating Station, Units 2 and 3)
By letter dated January 21, 1980, the Southern California Edison Company sub mitted calculations concerning the "Reanalysis of Electrical Cable Tunnels" and requested that they be withheld from public disclosure pursuant to 10 CFR 2.790.
A non-proprietary version of the calculations and your related affidavit were also transmitted by the letter from Southern California Edison Company.
Your affidavit stated that the reasons for requesting our withholding of this information were: (1) the documents contain trade secrets which are customarily held in confid nce by Bechtel; (2) the documents contain information which pro vides Bechtel with a competitive advantage; and (3) the information contained in the documents is not available in public sources.
We have reviewed your affidavit and material based on the requirements and cri teria of 10 CFR 2.790 and have determined that the above-mentioned documents sought to be withheld contain trade secrets or confidential or proprietary com mercial or financial information.
We also have found at this time that the right of the public to be fully apprised as to the bases for and effects of the proposed action does not outweigh the demonstrated concern for protection of your competitive position. Accordingly, we have determined that the information should be withheld from public disclo sure.
We therefore approve your request for withholding pursuant to Section 2.790 of 10 CFR Part 2 and are withholding the calculations as proprietary.
Withholding from public inspection shall not affect the right, if any, of per sons properly and directly concerned to inspect the documents. If the need arises, we may send copies of the report to our consultants working in this area. We will, of course, assure that the consultants have signed the appro priate agreements for handling proprietary data.
