Thank you for your letter dated January 28, 1983, which responded to our December 10, 1982 request for an additional $2,800 for your August 16, 1982 application and $4,000 for your September 30, 1982 application.

While your Company paid the $2,800 additional fees requested pursuant to 10 CFR 170 for your August 16 application, only $1,200 (a Class II fee) was paid for your September 30 application for authority to oper ate Unit No. 2 in MODES 2 and 3 with the turbine overspeed protection system inoperable. Your Company determined that the turbine overspeed Technical Specification (TS) change had already been incorporated in the San Onofre Unit No. 3 TS prior to your proposing the change for Unit No. 2. Consequently, no additional safety evaluation above and beyond that performed for Unit No. 3 was required.

The Division of Licensing (DL) review staff has informed us that the review was conducted on Unit No. 2 prior to the issuance of the Unit No. 3 License No. NPF-15 on November 15, 1982, and that Unit No. 3 required no additional safety evaluation over that performed for Unit No. 2. In addition, the "proof and review" Technical Specifications analysis for Unit No. 3 was not complete at the time the Unit No. 2 change was approved. Consequently, the review was initially done for Unit No. 2 rather than Unit No. 3. On this basis, it is concluded that the previously requested Class III fee of $4,000 for your Septem ber 30 application is still appropriate.
