NINE MILE POINT NUCLEAR STATION - NOTICE OF REGULATORY CONFERENCE

Dear Mr. Costanzo:

This letter confirms our plans, as discussed between members of our staffs, to hold a Regulatory Conference to discuss a preliminary Greater than Green finding and associated apparent violation (AV). The details regarding the issue were conveyed to you in our Inspection Report Nos. 05000220/2013003 and 05000410/2013003, dated August 13, 2013 (ML13225A471), and letter dated September 23, 2013, Nine Mile Point Nuclear Station, Units 1 and 2 - NRC Integrated Inspection Report 05000220/2013003 and 05000410/2013003; Preliminary Greater than Green Finding and Apparent Violation, (ML13266A237). The meeting will begin at 12:00 pm on Friday, November 1, 2013, at the U.S. Nuclear Regulatory Commission (NRC) Region I Office, 2100 Renaissance Boulevard, King of Prussia, PA 19406.

This meeting will be open to the public.

The Regulatory Conference is being held to obtain information to assist the NRC in determining the safety significance of the finding and AV detailed in the referenced inspection report. The conference will provide an opportunity for you to present your perspective on the facts and assumptions used by the NRC to arrive at the finding, your assessment of the significance of the finding, and any other information that you believe the NRC should take into consideration in making an enforcement decision.

The NRC would appreciate receiving any supporting documents no later than Monday, October 28, 2013, in order to make the conference more effective and efficient.

Following the conference, you will be advised by separate correspondence of the results of our deliberations on this matter.

In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records System (PARS) component of NRCs Agencywide Documents
