On March 12, 2012, the Nuclear Regulatory Commission (NRC) issued Reference 1 to all power reactor licensees and holders of construction permits in active or deferred status.
The Enclosures of Reference 1 contain specific Requested Actions, Requested Information, and Required Responses associated with Recommendations 2.1, Seismic, 2.3, Flooding and 9.3, Emergency Preparedness.
By letter dated February 25, 2013, Dominion Energy Kewaunee (DEK) informed the NRC of its intention to permanently cease operation of Kewaunee Power Station (KPS) on May 7, 2013 (Reference 2). Subsequently, by separate letters dated February 26, 2013 (References 3 and 4), DEK submitted a Post-Shutdown Decommissioning Activities Report (PSDAR) (as required by 10 CFR 50.82(a)(4)(i)) and an update to the KPS Irradiated Fuel Management Plan (as required by 10 CFR 50.54(bb)).
By letter dated May 14, 2013, DEK submitted a certification of permanent removal of fuel from the reactor vessel pursuant to 10 CFR 50.82(a)(1)(ii) (Reference 5). Therefore, as specified in 10 CFR 50.82(a)(2), the 10 CFR Part 50 license for KPS no longer authorizes operation of the reactor or emplacement or retention of fuel into the reactor vessel.
The recommendations in Reference 1 are intended for operating units.
As Reference 1 indicates, "Operating power reactor licensees under 10 CFR Part 50 are required to respond to R-GoO1
Serial No.13-350 Docket No. 50-305 Page 2 of 2 all of the information requests." The list of licensees to which Reference 1 applies does not include permanently shutdown units. KPS is no longer an operating plant, but is rather a plant where the reactor has been permanently shut down and defueled. Therefore, DEK considers the request of Reference 1 to no longer be applicable to KPS and no longer plans on proceeding with any further implementation of the recommendations in Reference 1 or any alternative approach for Recommendations 2.1, 2.3 and 9.3.
