Dear Administrative Judges:

In accordance with the ASLBs directive during the teleconference call held on June 10, 2013 1 and the ASLBs June 10, 2013 Order, 2 in the above-referenced proceeding, Riverkeeper writes to inform the ASLB of Riverkeepers position relating to the amount of time that may be necessary in order to file motions for new or amended contentions based upon the issuance of NRC Staffs supplement to the Indian Point Final Supplemental Environmental Impact Statement (FSEIS),

which was provided to the parties on or about June 21, 2013.

Riverkeeper has conducted an initial review of NRC Staffs FSEIS supplement, and has preliminarily determined to file a motion seeking an amendment to Riverkeeper Contention EC-8, which pertains to the sufficiency of NRC Staffs analysis of the impact of Indian Point on endangered species. Riverkeeper respectfully submits that, due to the significant nature of the 1

50-0247-LR and 50-286-LR, ASLBP No. 07-858-03-LR-BD01, Order (Granting New Yorks Motions, Denying Clearwaters Motion, and Denying CZMA Motions) (June 12, 2013) (Finally, the parties have 10 days after the publication of the forthcoming FSEIS to inform the Board whether 30 days will be sufficient time to file motions for new and amended contentions (footnotes omitted)).

NRC Staffs FSEIS supplement, as evidenced by the lengthy amount of time NRC Staff invested in the production of the FSEIS supplement, as well as preexisting summer vacation schedules, 30 days may not be an adequate amount of time to file the contemplated amended contention, and that 45 days is a more appropriate timeframe to do so. Riverkeeper submits that a 45-day period of time to file a motion to amend Riverkeeper Contention RK-EC-8 is not likely to have a material effect on the timing of the overall proceeding, in light of the unresolved status of several outstanding contentions.
