CRYSTAL RIVER UNIT 3 NUCLEAR PLANT - REVIEW OF NOTIFICATION OF CHANGE IN PEAK CLADDING TEMPERATURE (TAC NO. ME8408)

Dear Mr. Franke:

By letter dated March 19,2012 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML12081A278), Florida Power Corporation, the licensee for Crystal River Unit 3 Nuclear Plant (CR-3), notified the U.S. Nuclear Regulatory Commission (NRC) of a change in peak cladding temperature of greater than 50 degrees Fahrenheit in the CR-3 Large Break Loss-of-Coolant Accident analysis. This notification was made subject to the requirements in Title 10 of the Code of Federal Regulations (10 CFR), Section 50.46, "Acceptance Criteria for Emergency Core Cooling Systems for Light-Water Nuclear Power Reactors."

The NRC staff performed a review of the licensee's submittal in accordance with the requirements in 10 CFR 50.46, and on October 26,2012 (ADAMS Accession No. ML12304A068), the NRC staff requested additional information. On December 10, 2012 (ADAMS Accession No. ML12353A093) the licensee provided its response to the NRC staff's request.

Subsequently, on February 5, 2013, Progress Energy Florida, a subsidiary of Duke Energy, announced that it will retire CR-3. The licensee has provided certification of permanent cessation of power operations, and that the fuel has been removed from the reactor vessel (see ADAMS Accession No. ML13056A005). As a result, the NRC staff has stopped work on this review, has no further questions, and will close Task Activity Code ME8408.
