Response to Supplement to Oyster Creek 2.206 Petition Importance: High

Dear Mr. Webster:

On November 19, 2012 (ADAMS Accession No. ML12326A361), you submitted to the NRC, a 10 CFR 2.206 petition regarding your concerns at Oyster Creek. Section 2.206 of Title 10 of the Code of Federal Regulations describes the petition process

- the primary mechanism for the public to request enforcement action by the NRC in a public process. This process permits anyone to petition NRC to take enforcement-type action related to NRC licensees or licensed activities. Depending on the results of its evaluation, NRC could modify, suspend or revoke an NRC-issued license or take any other appropriate enforcement action to resolve a problem. The NRC staffs guidance for the disposition of 2.206 petition requests is in Management Directive (MD) 8.11, which is publicly available (ADAMS Accession No. ML041770328).

In accordance with MD 8.11, Part III.A.1 (page 7), the Petition Review Board (PRB) met on November 26, 2012, to review the request for immediate action regarding your emergency 2.206 petition regarding lack of adequate protection of safety at Oyster Creek. The PRB denied the request for immediate action to take emergency enforcement action to prevent Oyster Creek from starting up from its refueling outage, because there was no immediate safety concern to Oyster Creek, or to the health and safety of the public (ADAMS Accession No. ML12331A345).

On November 28, 2012 (ML12338A234), you requested to have a public meeting to address the PRB. On November 30, 2012 (ML12338A240), you informed the NRC that you would make a formal request for a public meeting to address the PRB.

On November 30, 2012 (ML12338A246), you made a formal request for a public meeting

to address the PRB with supplemental information and you requested that the meeting be held close to Oyster Creek.

Referring back to my email dated November 30, 2012 (ML12338A234), the purpose of the public meeting is to give you an opportunity to provide any additional explanation or support for the petition before the PRB's initial consideration and recommendation. The meeting is not a hearing, nor is it an opportunity for you to question or examine the PRB on the merits or the issues presented in the petition request. No decisions regarding the merits of the petition will be made at the meeting. The public is invited to observe the meeting and will be able to ask 2.206 petition process questions only after you have completed your presentation. The NRC will transcribe the meeting by a court reporter, and the NRC will make a bridge line available for the public. In addition, the NRC will webcast the meeting for the public. For these reasons, the NRC will hold the meeting in the NRC Commissioners Hearing Room on January 3, 2013.
