Nine Mile Point Nuclear Station Unit Nos. 1 and 2; Docket Nos. 50-220 and 50-410 2012 Summary of Regulatory Commitment Changes This letter forwards a summary of regulatory commitment changes requiring NRC notification in accordance with the guidance contained in Nuclear Energy Institute (NEI) 99-04, "Guidelines for Managing NRC Commitment Changes," Revision 0, during the period October 1, 2011 to September 30, 2012. The Attachment to this letter identifies the commitment changes, including the source document and a brief statement of the basis for each change.

SUMMARY

OF REGULATORY COMMITMENT CHANGES Unit: Nine Mile Point Units 1 and 2 (NMP1 and NMP2)

Commitment:

Continue to participate in the Joint Owners' Group (JOG) program for periodic verification of motor-operated valves (MOVs), with the remaining task of implementing the program elements described in Topical Report NEDC-32719, Revision 2. This commitment is associated with the Nine Mile Point Nuclear Station, LLC (NMPNS) response to NRC Generic Letter (GL) 96-05, "Periodic Verification of Design-Basis Capability of Safety-Related Motor-Operated Valves."

Revised Commitment:

NMPNS has implemented the provisions of American Society of Mechanical Engineers (ASME) Code Case OMN-1, "Alternative Rules for Preservice and Inservice Testing of Certain Electric Motor-Operated Valve Assemblies in Light-Water Reactor Power Plants OM Code-1995, Subsection ISTC," to satisfy the recommendations in GL 96-05 for periodic verification of MOV design basis capability.

Justification for Change:

By letter dated December 29, 2008, the NRC authorized the NMPNS-proposed alternative specified in relief request GV-RR-01 regarding the application of ASME Code Case OMN-1. NMPNS has updated the NMP 1 and NMP2 Inservice Testing program accordingly.

In NRC Regulatory Issue Summary (RIS) 2011-13, the NRC concluded that ASME Code Case OMN-1 is an adequate approach for establishing a program to ensure that safety-related MOVs continue to be capable of performing their design basis safety functions.
