x DECLARATION OF JANICE A. DEAN Pursuant to 28 U.S.C. § 1746, Janice A. Dean hereby declares as follows:

1. I am an Assistant Attorney General for the State of New York, counsel for petitioner-intervenor State of New York in this proceeding.
2. In 2009 I sent Entergys counsel a letter seeking a 1968 A.V. Smith Engineering Company Report referenced in Entergys Updated Final Safety Analysis Report (UFSAR),

Revision 20, at section 5.1.3.12. Revision 20 is the version of the UFSAR Entergy submitted with its license renewal application. It is annexed hereto as NYS Exh. NYSR0014A-J.

3. As Entergy states in the UFSAR, the A.V. Smith Engineering Company Report conducted a complete survey and tests to determine the need for cathodic protection on Indian Point Unit 2.
4. This information is relevant to the States contention because buried pipes at Indian Point have corroded, indicating that proper aging management procedures have not been, in place at Indian Point, creating a baseline of degraded pipes to be managed by Entergys aging management program for buried pipes which is at issue in Contention NYS-5.
5. Entergy objected to producing this study in a letter annexed hereto as Exhibit NYS000204 because the FSAR is part of the current licensing basis (CLB) and the CLB is not subject to attack in this proceeding. Furthermore, for license renewal, Entergy does not take credit for cathodic protection for buried piping systems that contain radioactive fluids. Letter, Paul Bessette, Esq. to Janice A. In fact, Entergy has produced virtually no documents from the period of Consolidated Edisons construction and operation of Indian Point Units 1 or 2 or New York Power Authoritys construction and operation of Unit 3 such that the State could evaluate the conditions under which decisions were made concerning buried piping at the time of construction.

6. On July 22, and August 4 and 5, 2009, Entergy and NRC Staff held teleconferences concerning Entergys response to an RAI concerning the Buried Piping and Tanks Inspection program. See Email, Kimberly Green to Michael Stroud and Donna Tyner,
