x UNOPPOSED MOTION BY STATE OF NEW YORK REQUESTING MODIFICATION OF BOARDS OCTOBER 4, 2012 ORDER Office of the Attorney General for the State of New York The Capitol State Street Albany, New York 12224

This motion by the State of New York is not opposed by the other parties in this proceeding.

On Monday, October 1, 2012, the State filed a revised exhibit list (NYSR15001). On Tuesday, October 2, 2012, the State realized that an attorney declaration had been inadvertently included on this list as NYS000442, and submitted a corrected revised exhibit list (NYSR16001).

The State had submitted the attorney declaration in support of its earlier September 18, 2012 motion for leave to file an additional exhibit and additional cross-examination questions concerning Contention NYS-12C, but not as evidence in support of the contention.

On Thursday, October 4, 2012, the Board issued an order granting the States motion and holding that it will give all other parties until October 9, 2012 to file proposed questions concerning the exhibits now marked as NYS000441 and NYS000442. Given that the State has not proffered NYS000442 as an exhibit, the State respectfully submits that parties should not submit cross-examination questions on this document. The declaration provides background information for the States September 18 motion, and does not contain substantive evidence supporting NYS-12C. As such, the State respectfully requests that the Board revise its October 4, 2012 Order to delete the reference to NYS000442.
