September 28, 2012 EN 12-042 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Carolina Power and Light Company EA-12-132 Shearon Harris Nuclear Power Plant Docket No. 50-400

Subject:

ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation associated with a White Significance Determination Process (SDP) finding will be issued on or about October 3, 2012, to Carolina Power and Light Company (CP&L), as a result of inspections at Shearon Harris. The White finding, an issue of low to moderate safety significance, will require additional U.S. Nuclear Regulatory Commission (NRC) inspections. This violation involves the failure of Harris personnel to maintain the effectiveness of their emergency plan, as required by 10 CFR 50.54(q) and 10 CFR 50.47(b), by ensuring that adequate emergency facilities and equipment to support the emergency response were provided and maintained. Specifically, on several occasions between August 4, 2009, and November 9, 2011, CP&L failed to maintain adequate emergency facilities and equipment to support emergency response when the Emergency Operations Facility (EOF) ventilation system was in a degraded state and/or removed from service, for extended periods of time.

CP&L will also be issued a Severity Level III violation for their failure to report a major loss of emergency assessment capability to the NRC during the periods of time that the EOF ventilation system was removed from service as required by 10 CFR 50.72(b)(3)(xiii).

At the request of the licensee, an enforcement conference was held on August 24, 2012. After reviewing the information developed during the inspection and the information provided in the conference, the staff concluded that the inspection findings are appropriately characterized.

CP&Ls corrective actions include documenting the technical requirements and administrative controls needed for the EOF to ensure performance of design and licensing basis functions.

It should be noted that CP&L has not been specifically informed of the enforcement action.
