SEABROOK STATION, UNIT NO.1 - REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE REGARDING RELIEF REQUEST FOR SERVICE WATER PIPING (TAC NO. ME9187)
Dear Mr. Walsh:
By letter dated August 1, 2012 (Agencywide Documents Access and Management System Accession No. ML12219A129), NextEra Energy Seabrook, LLC (NextEra) submitted relief request (RR) 11-04 for Seabrook Station, Unit 1 (Seabrook). The proposed RR is to use an alternative to the requirements of the American Society of Mechanical Engineers Boiler and Pressure Vessel Code (ASME Code),Section XI at Seabrook. NextEra plans to excavate and examine Class 3 Nuclear Service Water System buried piping in accordance with the requirements of the Seabrook Buried Piping Integrity Program. Should areas requiring repair be detected during these inspections, NextEra requests relief from ASME Code,Section XI, IWA 4400 requirements that defective portions of components be removed prior to performing a repair/replacement activity by welding.
By letter dated September 7, 2012, NextEra submitted an affidavit executed by Mr. Paul S.
Manzon of PMC Engineering Solutions, Inc., requesting that the information contained in the following document be withheld from public disclosure pursuant to 10 CFR 2.390: of the letter from NextEra to Document Control Desk (NRC) dated September 7, 2012: "ASME Section II, Class 3, Design Report for Pressure Maintenance Component (PMCap) for 24" Buried Service Water System Pipe Wall Restoration, PMC Restoration Method."
The affidavit stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:
Information that discloses a process, method, or apparatus, including supporting data and analysis, where prevention of its use by PMC Engineering Solutions, Inc.
competitors without license from PMC Engineering Solutions, Inc. constitutes an economic advantage over other companies.
Information which, if used by a competitor, would reduce their expenditure of resources or improve their competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing of a similar product.

- Information which discloses patentable subject matter for which it may be desirable to obtain patent protection.
The U.S. Nuclear Regulatory Commission (NRC) staff has reviewed your application and the material in accordance with the requirements of 10 CFR 2.390 and, on the basis of the statements in the affidavit, has determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.
Therefore, the above listed document marked as proprietary, will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, the NRC staff may send copies of this information to our consultants working in this area. The NRC staff will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
